Terms of Service

Welcome to CaseWiki. These Terms of Service ("Terms") govern your access to and use of the CaseWiki website, platform, and services (collectively, the "Service"), operated by CaseWiki Inc. ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age or the age of majority in your province or territory to use CaseWiki. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Not Legal Advice

CaseWiki provides legal information and AI-powered guidance for educational purposes only. The Service does not constitute legal advice, and no solicitor-client relationship is formed by using the platform.

Our AI assistant generates information based on Canadian statutes and legal resources. While we strive for accuracy, laws change and every situation is unique. For advice specific to your circumstances, consult a licensed Canadian lawyer. CaseWiki is not a law firm.

3. Accounts

To access certain features, you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@casewiki.ca if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behaviour.

4. User Roles

4.1 Individual Users

Individual users may access AI legal reports, community Q&A, and the lawyer directory. Free and paid plans are available as described on our Pricing page.

4.2 Lawyers

Lawyers may create professional profiles upon bar verification. By signing up as a lawyer, you represent that you are a member in good standing of a Canadian provincial or territorial law society. We verify credentials against public bar registries. Providing false credentials will result in immediate account termination.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any applicable law
  • Submit false, misleading, or fraudulent information
  • Attempt to reverse-engineer, decompile, or extract the source code of our AI models or proprietary systems
  • Use automated tools to scrape, crawl, or harvest data from the Service
  • Harass, abuse, or threaten other users or CaseWiki staff
  • Impersonate any person or entity, including a licensed lawyer
  • Circumvent or attempt to circumvent usage limits or payment requirements

6. AI-Generated Content

Our AI assistant generates reports based on your input and Canadian legal databases. AI-generated content may contain errors, omissions, or outdated information. You acknowledge that:

  • AI output is informational, not legal advice
  • Statutory citations should be independently verified
  • CaseWiki does not guarantee the accuracy, completeness, or currency of AI-generated content
  • Reliance on AI output is at your own risk

7. Payments and Subscriptions

Paid plans are billed monthly or annually as selected. All prices are in Canadian dollars (CAD) and subject to applicable taxes. Payments are processed through our third-party payment processor.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial billing periods, except as required by applicable consumer protection legislation.

8. Intellectual Property

All content, design, code, and intellectual property on CaseWiki is owned by CaseWiki Inc. or its licensors. You may not copy, modify, distribute, or create derivative works without written permission.

You retain ownership of information you submit to CaseWiki. By submitting content, you grant us a limited, non-exclusive licence to use it for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by Canadian law, CaseWiki Inc., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to reliance on AI-generated content.

Our total liability for any claim related to the Service shall not exceed the amount you paid to CaseWiki in the 12 months preceding the claim, or $100 CAD, whichever is greater.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

11. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the platform. Continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you may close your account.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
